Since Uber co-founder Travis Kalanick was pressured to resign from the CEO post in late June, the search for a new chief executive has devolved into a messy battle among the company's board members.

The legal request follows another letter sent Thursday to Uber and Garret Camp, who is chairman of the app-based taxi company's board, in which Pishevar accused Benchmark of violating its fiduciary duty as a significant investor in Uber.

Benchmark still believes that Meg Whitman would be less tolerant of Kalanick's antics and won't be "open towards the pugnacious entrepreneur", Recode added.

Hewlett Packard Enterprise CEO Meg Whitman is "on the fence" with regard to whether she would consider an offer to be the next CEO of the embattled ride sharing company because she wants a "rejiggered board and wide latitude" over management changes, according to a report from Recode. Immelt was among three finalists for the job at the ride-services company, according to sources close to the situation. He did not elaborate on why he was pulling out of the race, but the people with knowledge of the process said Mr. Immelt did not have enough board votes to become C.E.O. Immelt tweeted late Sunday morning. Whichever candidate the board chooses will be the person to usher the company into the post-Travis Kalanick era.

Immelt, who stepped down as GE's CEO at the beginning of this month, faced opposition from some of Uber's major backers.
