Supreme Court Sides With Trump Administration Over Refugee Ban (For Now)

Trump's March 6 executive order said the temporary travel ban and refugee ban would give officials time to assess US vetting procedures and would address the risk that terrorists could slip into the country.

The Supreme Court will allow the Trump administration to keep blocking a large group of would-be refugees from entering the United States during the 120-day halt to the refugee program under President Trump's travel ban executive order.

The judge also determined that refugees from the six countries who already had been accepted for resettlement by a sponsoring agency should be able to enter the U.S. That decision was set to take effect Tuesday, and as many as 24,000 refugees have received such assurances, the administration said in papers filed with the high court.

In June this year, the justices had said the Trump administration could not enforce the travel bans against people who have a "bona fide" relationship with people or entities within US. President Barack Obama said 110,000 refugees should be allowed in the U.S.in 2016, the report said.

The Trump administration is in discussions to reduce the number of refugee admissions to as low as 15,000, The New York Times reported Tuesday, citing current and former government officials familiar with the discussions. The court rejected the government's claim that a "close familial relationship" was limited only to members of a nuclear family (plus in-laws) as an "unreasonabl [e]" and "artificially narrow interpretation" of the Supreme Court's ruling.

On the other hand, the court said, relationships formed for the goal of evading the travel ban did not count.

Last month, the justices said additional relatives deserved entry, but not additional refugees, leaving the appeals court in California to sort out the details.

The Supreme Court will hear the immigration ban case on October 10. The Ninth Circuit held that the "written assurance [a refugee resettlement] agency submits [to the State Department]..." creates a "bona fide relationship" as described by the Supreme Court. Federal District Court Judge Derrick Watson in Hawaii later ordered the list expanded to include grandparents, grandchildren, aunts, uncles, cousins and in-laws. Acting alone, he blocked implementation of the Ninth Circuit's ruling pending receipt of a response from the travel ban's challengers, due on September 12th at noon.

12 ruling, issued without comment, stopped the refugee exemption that would have taken that day under the 9th Circuit's ruling issued five days earlier.
