Home Minister Rajnath Singh today reiterated that Rohingya Muslims living in India are not refugees but illegal immigrants from Myanmar, and that objections to deport them are baseless since Myanmar has expressed its willingness to take them back.

On August 8 Joint Secretary in the Ministry of Home Affairs dilip Kumar wrote to chief secretaries of all states requesting them to identify Rohingyas who had entered India and deport them.

Dismissing those challenging the secular credentials of the government in insisting on deporting Rohingya refugees, Madhav said there was nothing communal about the decision. But none of them followed the procedure.

"No Rohingya has got asylum in India nor anyone has applied for it. No illegal immigrant can pray for a writ of this court which directly or indirectly confers the fundamental rights in general...", the affidavit said, urging the court to throw out the PIL filed by two Rohingyas. It says the Rohingya can not use the 1951 Refugee Convention or the 1967 Protocol Relating to the Status of Refugees since India was not a signatory to either.

The Rohingyas have been fleeing Myanmar for decades and the exodus has seen a marked increase over the past few months amid reports of mass killings of the ethnic minority by the Myanmar military despite appeals for calm and peace directed at Myanmar state counsellor and Nobel Peace laureate Aung Saan Suu Kyi by the worldwide community and rights activists. Asserting that the presence of Rohingyas in India would be a drain on the resources of the country and would affect the rights of the people, the Centre on Monday pointed out that some of the Rohingyas had contacts with Pakistan-based terror outfits. The commission had justified its "intervention" as appropriate, considering that it involved a human rights problem. The government has refused to acknowledge the Rohingyas as a religious minority. "India is not even a signatory to the 1951 UN Refugee Convention".

The top court began hearing the plea Monday. Adding further, the minister said that India would not violate any global law by deporting Rohingyas as it was not a signatory to the UN Refugees Convention 1951. "I would like to request the International Human Rights Committee and Commissions to not spread anything wrong against India", he told media here. The military junta - that ruled Myanmar for many years was accused of ethnic cleansing of Rohingyas by the United Nations - forced a lot of the latter to flee to Bangladesh in the 1970s.

Prime Minister Narendra Modi reiterated that support earlier this month when he visited Myanmar and met with its leader, Aung San Suu Kyi. Thousands of Rohingya Muslims have fled to Bangladesh from Myanmar.
