GOP senator vows to reject SCOTUS nominee who is pro-life, would vote to overturn Roe v. Wade

In another Sunday morning interview, Collins said she would not support a Trump nominee who she believed would support overturning Roe v. Wade.

Trump has said he is focusing on up to seven potential candidates, including two women, to fill the vacancy created by Kennedy, a swing vote on the nine-member court.

Collins noted that she was in favor of moving forward with a nominee in the next couple months, so a new justice could be in place by the time the Supreme Court's next term begins in October.

Collins appeared on ABC's "This Week" and CNN's "State of the Union," and Leo spoke on "Fox News Sunday".

And it said a team of lawyers from the White House and Department of Justice are gathering information to assist Trump with the process.

Nelson "probably perceives that no one on that list of 25 is someone he is prepared to vote for and so it shouldn't be surprising", said Carl Tobias, a professor at the University of Richmond College of Law, who specializes in federal judicial selection.

After Kennedy announced his retirement last week, Nelson immediately faced pressure from both ends of the political spectrum. Collins said she would only back a judge who would show respect for settled law such as the Roe decision, which has always been anathema to conservatives.

"There are not a lot of nominees on that list that many Democrats will support", said Tobias, noting that any candidate backed by the Federalist Society is likely comfortable overturning Roe v. Wade. He also has said he will announce his nominee to replace retiring Justice Anthony Kennedy July 9.

"A number of judges (have told me) that good judges are always unhappy with some of their decisions but they make the right call regardless of their personal views".

It's not entirely clear how current conservatives on the Court would vote on the issue of overturning Roe v. Wade. "Is it fair to say that the president won't pick someone who has a record of opposition to Roe v. Wade?".

If there is a danger of losing Republican votes, the nominee could prevail by courting Democratic senators seeking re-election this year in states Trump carried in 2016, including Sens. On Monday, Senate Minority Leader Charles Schumer, D-N.Y. criticized the record of U.S. Appeals Court Judge Amy Coney Barrett of IN, who is one of seven judges considered to be front-runners.

Such a judge, she said, "would not be acceptable to me because that would indicate an activist agenda".

She said she believed it would be inappropriate to ask a nominee how they would vote on a future case.

In a series of tweets, Schumer argued that Barrett would support overturning the landmark Roe v. Wade abortion rights decision.
